Terms and Conditions

These Terms and Conditions relate to activities conducted by Protectus Pty Ltd ABN 14 090 602 378 trading as Gallery 307 Art School at and from 305 – 307 Sailors Bay Road, Northbridge, NSW 2063.
Please read them carefully before completing your enrolment/booking and making payment.
In the Terms and Conditions listed herein:
“Session” means an individual adult or child workshop or class.
“Course” means any term or school holiday program or other block of workshops or classes for children or adults.

Cancellation and Refund Policy

Gallery 307 Art School reserves the right to amend any session, course, tutor or schedule at any time. In such circumstances, we will endeavour to provide a substitute of equal standing.
If a session or course is cancelled due to insufficient enrolments, any student enrolled in that session or course will be contacted and a credit, refund or alternative session(s) arranged.
NO refunds, transfers or credits will be permitted if you withdraw or cancel less than 7 days prior to commencement of a session or once a course has commenced.
Subject to negotiation, fees may be refundable in the event of an extended or sudden illness.
Missed sessions
There are no transfers, credit, refunds or make up sessions if you miss a session/course or (other than an extended illness), your personal circumstances change.
Cancellation of enrolment
If you choose to withdraw from a session or course up to 7 days before commencement, you will be charged a $25 administration fee. You may transfer the remaining value (fee paid less administration fee) to another session, course or student, to be used within 12 months of the date payment was received. You will not receive a refund for the fee paid.
Transfers – school holiday courses
If you need to transfer a holiday booking to a different session within the same holiday course, you can do this at no charge, provided you make the arrangements before the commencement of our school holiday course. Transfers made after the school holiday course has commenced and UP TO 48 hours before the session date will incur a fee of $10.
Requests for transfers made within 48 hours of a session commencement, will not be accepted.
You may transfer a booking to a different child (e.g. friend/sibling) at any time at no cost.

Enrolments and Payment of fees

Enrolments
Online enrolment via our website, is the preferred enrolment option, however, you may opt to enrol in person by visiting our office, by emailing us directly or calling us on 02 9958 1298.
Payment of fees
Session/course fees are listed with the session/course details on the Gallery 307 Art School website. (see above). Payment of the full fee including GST via online credit card payment, is required at the time of enrolment to secure your placement. We accept Visa, MasterCard and American Express. A Credit Card fee may be charged. Payments by cash, cheque or by Direct Credit into our bank account. are accepted but must be arranged specifically with us.
Fees are inclusive of GST and tax receipts will be provided on receipt of payment. A Credit Card processing fee may also be charged.

Discounts on fees

We offer a 10% sibling discount on term or holiday program fees will be applied to the second and subsequent children from the same family for school term or school holiday courses.

Gift Certificates

‘Purchased’ gift certificates are valid for 12 months from the date of purchase or until the date listed on the certificate. Our Cancellation and Refund policy applies to ‘Purchased’ gift certificates used to pay for classes.

‘Complimentary’ gift certificates are issued from time to time as prizes for competitions and fundraisers. These are valid for 6 months from the date of issue or until the date listed on the certificate. No extensions will be given. ‘Complimentary’ gift certificates cannot be used in conjunction with any other discount, special offer or gift certificate.

No cancellations, transfers or credits are possible when a ‘Complimentary’ gift certificate is used to pay for a class.

Absenteeism

Fees are non-refundable, unless negotiated for an extended illness, and there are no transfers, refunds or make up sessions if you miss a class or if your personal circumstances change.

Art Materials

Materials lists for Adult classes are included in the class information on the websites. Students are required to supply their own art materials unless otherwise specified in the course or workshop description. Materials are supplied for children’s art classes and holiday workshops. Occasionally, a children’s session may require additional items to be supplied by the student. When this occurs, details will be provided on enrolment.

Completed Works

All work must be collected by the end of the Term or block of sessions. Any work not collected may be disposed of at the discretion of Gallery 307 Art School.

Course Recognition

Gallery 307 Art School is not a Registered Training Organisation and as such, courses are not accredited. However we do strive to deliver excellence in art education. A Record of Attendance can be provided on request following completion of a course.

Photography

From time to time we may take photos or videos of students and artworks which may be used for promotional purposes such as press advertising, brochures, social media, editorials and website. These photos and videos will never be sold and will be used exclusively by and for Gallery307 Art School. As a Condition of Enrolment your consent is implied.
Should you wish us not to take and use photos or videos of you, your child or your artwork please notify us in writing.

Student conduct

Gallery 307 Art School is a shared space and we expect students to respect fellow artists, artwork and property. Discrimination on the grounds of a person’s age, race sex, gender, sexuality, marital status, physical or intellectual disability, or religion will not be tolerated. Children or adults deemed to be exhibiting inappropriate or disruptive behaviour may be removed, suspended or expelled from the class/workshop. It should also be noted that cleaning of your art space and common areas is a shared responsibility.

Punctuality

Out of respect for other students and tutors, students are requested to be punctual for sessions. Unless alternative arrangements have been agreed to, children should be escorted to G307 by a parent or guardian, signed in on arrival and collected promptly at the end of each session. Gallery 307 Art School reserves the right to charge a late pickup fee of $10 per 15-minute block for pickups more than 10 minutes after finishing time.

Health, Safety & Allergies

If you or a child attending Gallery 307 Art School have an existing medical condition, allergy or disability that may affect your/their participation in a class, you should notify the Director, Gallery307 Art School, at the time of enrolment.

Privacy

Except where required by the Privacy Act or other legislation, contact information you supply to Gallery 307 Art School will not be disclosed outside Gallery 307 Art School without your express consent.
We do not retain any credit card information that you may provide.

Mailing List

Gallery 307 Art School will from time-to-time send mail and email to students, past students, tutors, artists and others for marketing purposes
Should you not wish to receive mailings, please notify us at enrolment. Alternatively, you may subsequently notify us by email directly or by phone on 02 9958 1298.

Gallery Rental and the Exhibition/Display of Artworks & other items

Conditions for the Exhibition or Display of Artworks and other items
Gallery 307 Art School rents gallery space by the week and by room space for Art Exhibitions.
Gallery Bookings
A non-refundable 50% deposit is required when booking a space for an Art Exhibition and until the deposit is paid, we cannot confirm a booking. The balance of the gallery hire is payable 7 days prior to the exhibition/event opening and is non-refundable in the event of cancellation.
Commission, at a rate to be agreed between Gallery 307 Art School and the exhibitor, will generally apply to artworks sold during the exhibition. An agent fee is also applicable to all sales made or commissions arranged through Gallery contacts prior to or after the exhibition.
Individual or multiple artworks owned by the same person/entity may be accepted for Exhibition and Display without renting a room, in which case, commission at a rate to be agreed, will be payable on all sales.
Subject to negotiation between Gallery 307 Art School and Exhibitors, and except for specific exhibitions, works exhibited must generally be available for sale.
Other rental options (e.g. by the hour or day etc.) may be available by negotiation. Subject to negotiation, a fee per artwork exhibited or displayed may be charged in addition to or in place of any rental arrangements.
Images of Artworks
Image(s) depicting the artworks to be exhibited, must be provided prior to acceptance of a booking.
Right of refusal
Gallery 307 Art School reserves the right to reject artworks in terms of size, appropriateness or which in our opinion, offend public taste.
Gallery opening hours
Gallery 307 Art School will attend and supervise the Gallery, Tuesday to Friday 10.00 – 5.00 pm and Saturday 10.00 – 3.00pm. Exhibitors may, but are not required to, be in attendance during these hours.
Openings outside of these hours may be available by negotiation.
Hanging of Work
The Gallery will provide an experienced person to curate and hang the exhibition.
Invitations
On request, and at exhibitors' expense, Gallery 307 Art School can design and print invitations and arrange letter box drops for the exhibition.
Advertising
Inherent in exhibiting at Gallery 307 Art School is the understanding that each hirer and/or artist will promote the exhibition via social media and other means available to them.
When requested by the hirer, Gallery 307 Art School will promote the exhibition on its website and via social media.
Catering
Unless requested from and agreed to by Gallery307 Art School, catering for any opening night is the responsibility of the hirer.

Rental of space for non Art –related functions

Gallery 307 Art School also rents areas within the Gallery and its grounds for Book Launches, Dinner Parties and a range of other Community and private activities and functions.
Conditions of rental
The terms of function rentals are subject to negotiation between Gallery 307 Art School and hirers however, unless stated, a non-refundable 50% deposit is required when booking a space and until the deposit is paid, a booking cannot be confirmed. The balance of the fee is payable 7 days prior to the function and is non-refundable in the event of cancellation.

Indemnity and Insurance

By agreeing to these Terms and Conditions, you agree to indemnify Protectus Pty Ltd ABN 14 090 602 378 trading as Gallery 307 Art School from any accident, loss, damage or injury suffered by you, your child or property you own during any activity conducted by Gallery 307 Art School including the hire of premises or the exhibition / display of artworks or other items at 305 – 307 Sailors Bay Road, Northbridge NSW 2063.
It is recommended that exhibitors arrange their own insurance on all artworks and other items on display or exhibition.
